Okunade, LLP represents small and medium-sized businesses in a wide variety of industries and professions in business disputes and litigation, including breach of contract cases, tortious interference with contract, fraud, breach of implied covenant of good faith and fair dealing, regulatory issues, and other causes of action.

In one form or another, contracts are the foundation of all business relationships. Unfortunately, many contracts are not fully understood before they are signed. In some cases, this lack of understanding can cause friction between the parties, and can ultimately result in the breakdown of the business relationship, causing financial harm and other issues among the parties.

Okunade, LLP handles a wide variety of business disputes and represents small to mid-sized companies in a variety of business matters. Our clients trust us to provide honest and informed representation on their business matters and litigation.

PROBATE ADMINISTRATION AND LITIGATION

The area of probate and probate litigation is often fraught with challenges and complexities that involve intricate family dynamics that can exacerbate the already emotional probate process. Okunade, LLP handles all aspects of probate administration and probate litigation and helps its clients navigate and balance these delicate matters to ensure that our clients' objectives are met.

When a loved one passes away, their estate may go through a court-managed process called probate or estate administration where the assets of the deceased are managed and distributed. In general, only the assets that are held individually in the decedent’s name will pass through probate. Certain types of assets are “non-probate assets” and do not go through probate.

  • Probate Process

Every probate estate is unique. Although the laws governing probate can vary from state to state, most probate process involve the following steps:

    • Authenticating the last will and testament (if the decedent left a will).
    • Filing of a petition with the proper probate court to appoint a personal representative/administrator, or Executor/Executrix (in the case a will exists), to oversee the probate process and to settle the estate.
    • Notice to heirs under the will or to statutory heirs (if no will exists).
    • Inventory and appraisal of estate assets by Executor/Administrator.
    • Identifying potential creditor(s) and making payment of estate debt to rightful creditors.
    • Sale of estate assets.
    • Payment of estate taxes, if applicable.
    • Final distribution of assets to heirs.

Okunade, LLP can help represent personal representatives/administrators or interested parties navigate through the probate process, including assisting clients in any litigation or disputes that may result during the process.

  • Probate for Heirs & Beneficiaries

Probate questions can arise when an heir or beneficiary learns about property, funds, or other assets connected to someone who has died. In some situations, an estate may never have been opened, an asset may be discovered years later, or additional probate action may be necessary.

Okunade LLP helps heirs, beneficiaries, families, and personal representatives understand when Colorado probate may be required and what steps may be necessary to address the estate or assets involved.
